Terms and Conditions of Use

This section establishes the terms and conditions (hereinafter, the “General Conditions”) for the use of the contents and services (hereinafter, the “Services”) of the platform specified in clause 12 (hereinafter, the “Digital Platform”). The Digital Platform and the Services are provided by the company detailed in clause 12 (hereinafter, “BUSCO INMUEBLE”).

If you do not agree with the General Conditions, please leave the Digital Platform immediately and refrain from using and/or contracting the Services offered.

The user’s use of the Digital Platform shall be understood as full and unconditional acceptance of the General Conditions established herein. Hereinafter, the terms “You” and “User” shall be used to refer to all individuals and/or legal entities that, for any reason, access the Digital Platform and wish to contract the Services governed by these General Conditions.

Definitions

Digital Platform: Website and/or mobile application of "buscoinmueble.com".

User: Individual or legal entity that uses the Platform.

Advertiser: User who publishes properties for sale or rent.

Content: Information, images, texts and data published on the Platform.

Access to the Digital Platform

Access to the Digital Platform

Access to and use of the Digital Platform does not require prior subscription or registration by the User. However, the use of some of the Services offered through the Digital Platform may require the User’s subscription or registration and/or payment of a price.

At any time, “BUSCO INMUEBLE” may grant its Users access to enter the Digital Platform operated by “BUSCO INMUEBLE”, through the access credentials (username and password) that they may have created at the time to enter the Digital Platform.

Use of the Digital Platform

The User agrees to use the Digital Platform in accordance with these General Conditions, the applicable laws pursuant to clause 12, and morality and good customs.

The User is required to refrain from using the Digital Platform for unlawful, illegal or criminal purposes, that are contrary to the provisions of the General Conditions, Mexican legislation, harmful to the rights and interests of third parties, or that may in any way damage, disable, overload or impair the Digital Platform or prevent the normal use of the Digital Platform by Users.

Content of the Digital Platform

The contents of this Digital Platform, such as text, information, graphics, images, logos, trademarks, computer programs, databases, designs, functional architecture and any other material (hereinafter, the “Content”) are protected by the applicable laws in each jurisdiction pursuant to clause 12 including, but not limited to, laws on copyright, patents, registered trademarks, utility models, industrial designs and domain names.

All Content is the property of “BUSCO INMUEBLE” and/or its affiliated, subsidiary or controlling companies and/or any other related company or individual and/or its content providers. The compilation, interconnection, operation and arrangement of the contents of the Digital Platform is the exclusive property of “BUSCO INMUEBLE” and/or its related companies. The unauthorized use, adaptation, reproduction and/or commercialization of the Content may be sanctioned by the legislation in force in each jurisdiction.

You shall not copy or adapt the programming code developed by, or on behalf of, “BUSCO INMUEBLE” to generate and operate its web pages or digital platforms, which is protected by the applicable legislation in force in each jurisdiction.

Permitted Use of the Digital Platform

General Rules

Users are prohibited from using the Digital Platform to transmit, distribute, store or destroy material:

1. In violation of current regulations.
2. In a manner that infringes third-party rights or violates the confidentiality, honor, privacy, image or other personal rights of others.

Security Rules of the Digital Platform

Users are prohibited from violating or attempting to violate the security of the Website, including but not limited to:

1. Accessing data not intended for such user or logging into a server or account that the User is not authorized to access.
2. Assessing or testing the vulnerability of a system or network, or breaching security or identification measures without proper authorization.
3. Attempting to deny Service to any User, host or network, including, without limitation, by sending viruses to the Digital Platform, or through saturation or denial-of-Service attacks.
4. Sending unsolicited emails, including promotions and/or advertising of products or services.
5. Forging any TCP/IP packet header or any part of the header information in any email or forum discussion message.

Violations of system or network security constitute criminal offenses and may give rise to civil liability. “BUSCO INMUEBLE” will investigate cases of system security violations and may refer the matter to the competent judicial or administrative authority in order to prosecute the Users involved in such violations.

Prohibited Uses

The Digital Platform may only be used for lawful purposes, to access information about the Services available through it. “BUSCO INMUEBLE” specifically prohibits any use of the Digital Platform to:

• Post incomplete, false or inaccurate biographical data.
• Register more than one account corresponding to the same user.
• Use any mechanism to prevent or attempt to prevent the proper functioning of this Digital Platform or any activity being carried out on this Digital Platform.
• Disclose or share your password with third parties, or use your password for unauthorized purposes.
• Use or attempt to use any machine, software, tool, agent or other mechanism to navigate or search this Digital Platform that differs from the search tools provided by “BUSCO INMUEBLE” on this Digital Platform.
• Attempt to decrypt, decompile or obtain the source code of any software program of this Digital Platform.

“BUSCO INMUEBLE” reserves the right to suspend or terminate any classified ad (free or paid), account or User that, at the sole discretion of “BUSCO INMUEBLE”, does not comply with the standards defined in these General Conditions or with the current policies of “BUSCO INMUEBLE”, without any right to reimbursement, and without liability or contractual penalty for “BUSCO INMUEBLE”.

Communication Channels Available to Users

The User must use the available communication channels —such as chats and discussion forums, among others— (hereinafter, the “Channels”) responsibly, correctly and in faithful compliance with current regulations.

The content of each message sent by the User through the Channels is the sole and exclusive responsibility of the User. “BUSCO INMUEBLE” does not guarantee the truthfulness of the personal data and/or content of each message made and/or published on the Channels by the User. The User voluntarily accepts that access to and/or use of the Channels takes place, in all cases, under the User’s sole and exclusive responsibility.

“BUSCO INMUEBLE” reserves the right to temporarily or permanently suspend from the Channels and/or Services without prior notice anyone who fails to respect these General Conditions or performs acts that threaten the normal operation of the Services and/or the Channels and/or the Digital Platform.

The User acknowledges and accepts that the following behaviors are strictly prohibited:

• Using vulgar/obscene, discriminatory and/or offensive language.
• Any type of personal attack against Users and/or third parties, including clients of “BUSCO INMUEBLE”, through harassment, threats, insults.
• Any act contrary to the law, morality and good customs.
• Publishing messages, images and hyperlinks that are offensive, defamatory, slanderous, insulting, false, discriminatory, pornographic, violent in content, insulting, threatening, that incite unlawful conduct or conduct dangerous to health, and/or that in any way violate the privacy of any third party as well as the direct or indirect violation of the intellectual property rights of “BUSCO INMUEBLE” and/or any third party, including clients of “BUSCO INMUEBLE”.
• Publishing messages that may hurt and/or affect the sensitivity of other Users and/or any third party, including clients of “BUSCO INMUEBLE”.
• Promoting, marketing, selling, publishing and/or offering any kind of products, services and/or activities through or by means of the use of the Channels, except those expressly permitted by “BUSCO INMUEBLE”.
• The sale, assignment, whether for consideration or free of charge, of the communication space of the Channels.
• Publishing messages that in any way contain advertising.
• The use or sending of computer viruses, malware, spyware, ransomware and/or the performance of any act that causes or may cause damage or harm to the normal operation of the Services and/or the Channels, or to the computer equipment or software of “BUSCO INMUEBLE” and/or any third party, including clients of “BUSCO INMUEBLE”.
• Any act aimed at masking and/or falsifying or concealing IP addresses, emails and/or any other technical means of identifying Users or their computer equipment.
• Any act that violates the privacy of other Users, or that violates any of their rights under the Federal Law on the Protection of Personal Data Held by Private Parties.
• The publication of personal data without the express consent of the data subject.
• The transmission or disclosure of material that violates the legislation in force in the country and/or that may hurt the sensitivity of other Users and/or any third party, including clients of “BUSCO INMUEBLE”.
• The publication of any type of content in violation of third-party rights, including without limitation intellectual and/or industrial property rights.
• Publishing classified ads (free or paid) for the lease and/or sale of real estate for unlawful, illegal or criminal purposes, that are contrary to the provisions of the General Conditions, Mexican legislation, or that are harmful to the rights and interests of third parties.
• As of June 1, 2024, publishing classified ads (free or paid) regarding real estate under judicial or bank foreclosure (unless the User acquired the auction ad product before such date or renews the product acquired prior to that date).
• Publishing classified ads (free or paid) regarding real estate classified as real estate projects in the brokerage section. These must be published as development cards in the exclusive section intended for such purpose.

“BUSCO INMUEBLE” has no obligation to control and does not control the use that the User makes of the Channels. However, “BUSCO INMUEBLE” reserves the right not to publish or to remove, after publication, all content and/or messages proposed and/or published by the User that, at the sole discretion of “BUSCO INMUEBLE”, do not strictly comply with the provisions contained in these General Conditions and/or are improper and/or inappropriate to the characteristics, purpose and/or quality of the Services.

“BUSCO INMUEBLE” does not guarantee the availability and continuity of the operation of the Channels.

“BUSCO INMUEBLE” is in no case responsible for the destruction, alteration or deletion of the content or information that each User includes in their messages.

Each User is solely and exclusively responsible for their statements, sayings, opinions and every act they perform through the Channels.

User Personal Data. Registration on the Digital Platform

When registering on the Digital Platform, you will be asked to provide “BUSCO INMUEBLE” certain information that will include, among others, first and last name, address, telephone number and a valid email address (as applicable), among others.

“BUSCO INMUEBLE” reserves the right to offer you third-party services and products based on the preferences you indicated at the time of registration or at any later time; such offers may be made by “BUSCO INMUEBLE” directly or by such third parties, for which “BUSCO INMUEBLE” may share with such third parties the information provided by the User in accordance with the Privacy Notice of “BUSCO INMUEBLE”.

Please consult the Privacy Notice of “BUSCO INMUEBLE” published on the Digital Platform to learn the details regarding the processing of your Personal Data.

The User shall be responsible for all uses of their account, whether authorized by You or not. You must immediately notify “BUSCO INMUEBLE” of any unauthorized use of your account or password.

Registered Users and/or those who use the Services of “BUSCO INMUEBLE” guarantee the truthfulness, accuracy, validity and authenticity of the information provided, and undertake to keep it duly updated, informing “BUSCO INMUEBLE” of any modification through the “Contact” section available on the main page of the Digital Platform.

The User authorizes the personal information provided to be shared with the clients of “BUSCO INMUEBLE” and the allies and third-party business partners referred to above.

“BUSCO INMUEBLE” reserves the right to contact and send Communications to Users by telephone, email, WhatsApp or other shared channels to communicate matters related to “BUSCO INMUEBLE”.

Minors

The use of the Digital Platform and/or the Services offered through it is prohibited for persons who lack legal capacity to contract or minors according to the applicable legislation pursuant to clause 12. If this occurs, minors or incapacitated persons must previously obtain permission from their parents, guardians or legal representatives, who shall be considered responsible for all acts performed by the persons under their care.

The Digital Platform is a constantly evolving community that includes various users with different experiences and backgrounds. Although “BUSCO INMUEBLE” may monitor and take action regarding inappropriate conduct by other users or third parties on the Digital Platform or access to or use of any of the Services offered, including chat rooms and public forums, language or other materials accessible in or through such spaces may at any time be inappropriate for minors or offensive to other users. These General Conditions set forth rules of conduct for users, but “BUSCO INMUEBLE” cannot guarantee that the other users will comply with them.

By accessing the Digital Platform and using the Services, the User confirms that they are of legal age.

User Responsibility

The User declares and accepts that the use of the Digital Platform, its Services and contents is carried out under their sole and exclusive responsibility and commercial risk.

In the event that a User detects an ad that, at their sole discretion, is misleading, fraudulent, incomplete, false and/or inaccurate, the User shall have the obligation to report it to “BUSCO INMUEBLE” using any of the following problem reporting tools that, as a good commercial practice, “BUSCO INMUEBLE” has implemented, and in order to offer quality content on the Digital Platform:

a) Problem report button

This tool is available in all ads published on the Digital Platform of www.buscoinmueble.com, and is located in the right panel of the ad. This tool is displayed as follows:

“Did you have a problem with the ad? Report it here”.

b) Customer service telephone

This tool consists of a telephone number attended by our customer service department. The User must call 5523201005. The User must expressly refer to the identification number ("ID”) of the respective ad.

c) Customer service email

This tool consists of an email attended by our customer service department. The User must send an email detailing the problem with the respective ad. The email is contacto@buscoinmueble.com. The User must expressly refer to the identification number ("ID”) of the respective ad.

Disclaimer of Warranties and Liability

Given the state of the art and the structure and operation of networks, the Digital Platform cannot confirm that each User is who they claim to be.

“BUSCO INMUEBLE” does not guarantee the availability and continuity of the operation of the Website and the Services offered. Not all Services and contents in general are available for all geographic areas. Likewise, “BUSCO INMUEBLE” does not guarantee the usefulness of the Website and the Services for carrying out any particular activity, nor their infallibility and, in particular, although not exclusively, that Users may effectively use the Website, access the different web pages that form the Website or those from which the Services are provided.

“BUSCO INMUEBLE” does not guarantee that the Website operates free of errors or that the Website and its server are free of computer viruses or other harmful mechanisms.

The Website and the Services are provided as is, without warranties of any kind.

“BUSCO INMUEBLE” does not guarantee the accuracy, truthfulness, completeness or updating of the contents, the Services, the software, the texts, the graphics and the links.

In no case shall “BUSCO INMUEBLE” be liable for any damage including, but not limited to, direct and/or indirect damages, loss of profits or losses resulting from the use or inability to use the Website, notwithstanding that “BUSCO INMUEBLE” has been advised of the possibility of such damages.

“BUSCO INMUEBLE” excludes all liability for damages and losses of any nature that may be due to the action of unauthorized third parties with respect to Users’ Personal Data, as well as the Services offered on the Website.

“BUSCO INMUEBLE” is in no case responsible for the misuse that advertiser Users give to the Website through the publication of classified ads that are or become misleading, fraudulent, incomplete, false and/or inaccurate.

Any User who uses the Website and contracts the Services does so assuming all risks involved. “BUSCO INMUEBLE” in no case guarantees that:

1. Advertiser Users are who they claim to be.
2. The rights or legal interest that advertiser Users have, or do not have, over the advertised properties.
3. The sale or rental prices of the advertised properties, in any modality, on our platform, and does not assume any obligation to verify such information.

“BUSCO INMUEBLE”, its directors, employees, shareholders or advisors, in no case draft or are responsible for the content of the ad published by advertiser Users.

“BUSCO INMUEBLE” expressly disclaims any warranty of merchantability, satisfactory quality, fitness for a particular purpose, peaceful use and enjoyment or non-infringement, as well as any express or implied warranty.

Links to Other Sites

The Website contains links to other Internet sites. “BUSCO INMUEBLE” does not endorse the contents of these websites. “BUSCO INMUEBLE” is not responsible for the content of third-party websites, nor for the services or products offered or provided by such third parties and makes no statement regarding the content or its accuracy on these third-party websites. If You decide to access linked third-party websites, you do so at your own risk.

Assignment or Unauthorized Commercial Use

You agree not to assign, under any title, your rights or obligations under these General Conditions. You also agree not to make any unauthorized commercial use of the Website.

Likewise, the User agrees to use the Website and the Services diligently and in accordance with the applicable and current law and these General Conditions.

Cancellation

“BUSCO INMUEBLE” has the authority, and not the obligation, to issue warnings, temporary suspensions and permanent cancellations (termination) of registered Users for infringements of these General Conditions, and/or any notice, rules of use and instruction made known to the User by “BUSCO INMUEBLE”.

Without prejudice to the foregoing, “BUSCO INMUEBLE” reserves the right, at its sole discretion, to use all legal means, actions and remedies available to it in the event that You infringe any of these General Conditions.

Users may cancel the Services they have contracted at any time and at their sole discretion, provided they give prior notice to “BUSCO INMUEBLE”. Notwithstanding the foregoing, they shall not be entitled to any refund for the Services contracted.

Indemnification

You agree to defend, indemnify and hold harmless “BUSCO INMUEBLE” and its affiliates and subsidiaries, and their respective counselors, directors, employees, representatives, agents and advisors, from any charge, judicial or extrajudicial action, demand of any nature, criminal complaint, claim or liability, penalty, fine or monetary sanction, of any nature and however denominated, arising from or in any way related to:

1. Any breach of these General Conditions or Mexican legislation.
2. The falsity or inaccuracy of any information, published by the User on the Website or on behalf of the User, including in relation to:
   • The advertised property(ies).
   • The advertiser’s ownership of the Property.
   • Their authority to sell or lease it.
   • The data provided to “BUSCO INMUEBLE” to create their account on the Website.
   • The content of any classified ad, whether free or paid.
3. Any interaction with any other User or any third party.

Such indemnification shall include but is not limited to reasonable attorney’s fees and expenses incurred by “BUSCO INMUEBLE” in defending itself against any process or proceeding brought against it.

You accept and acknowledge that “BUSCO INMUEBLE” is a mere intermediary, unrelated to any relationship that may be established between You and those who publish notices, ads and/or proposals through the Website. In this regard, You agree not to claim against “BUSCO INMUEBLE” for any type of consequence derived from such relationships.

General

“BUSCO INMUEBLE” reserves the right to modify these General Conditions, totally or partially, at any time, without the need for prior notice or consent from the Applicant, with the Applicant having no right to any indemnification or reimbursement for the Services contracted.

The updated General Conditions will be published on the Website, and it is the users’ obligation to regularly review this section to be informed of any change that may have occurred. The User accepts that the mere publication of the updated General Conditions by “BUSCO INMUEBLE” shall have full validity as sufficient notice.

Likewise, if the User persists in using the Services and/or the Website, it shall be considered that You acknowledge that you understand and expressly, irrevocably and unconditionally accept the new General Conditions.

In the event of a declaration of nullity of any of the clauses of these General Conditions, such nullity shall not affect the validity of the remaining clauses, which shall remain in full force and effect.

These General Conditions, together with the Terms and Conditions of Contracting, the Privacy Notice, constitute the complete agreement between You and “BUSCO INMUEBLE” with respect to the use of the Website, and the Contracting of the Services.

Duration and Termination

The provision of the Website Service has an indefinite duration. Without prejudice to the foregoing, “BUSCO INMUEBLE” is authorized to terminate or suspend the provision of the Website Service and/or any of the Contents at any time.

Google Calendar Integration Terms

This section forms part of the General Conditions and the Privacy practices applicable to Users who voluntarily connect their Google Account to the Digital Platform.

By enabling this integration, the User authorizes “BUSCO INMUEBLE” to access, process and manage certain Google user data strictly for the purposes described below.

1. Accessed Data

By connecting your Google account, you expressly authorize “BUSCO INMUEBLE” to access and process the following information:

a) Basic Profile Information

• Name.
• Email address.
• Google profile identifier.

This information is used solely for account identification and authentication within the Digital Platform.

b) Google Calendar Data

• View your calendars.
• Create events.
• Edit events.
• Delete events.
• Event metadata:
  • Title.
  • Description.
  • Start/end times.
  • Attendees.
  • Reminders.
  • Notes.

No access is made to Gmail, Drive, Contacts, or any other Google service that is not strictly necessary for the described functionality.

2. Use of Data

Google user data obtained through the integration is used exclusively for the following purposes:

Event Synchronization: Automatically reflect appointments created on the Digital Platform in your Google Calendar.

Schedule Management: Ensure that updates, cancellations or modifications made by the User are synchronized between both systems.

Identification: Use basic profile data to associate your Google account with your User profile on the Digital Platform.

Google user data is not used for advertising, profiling, non-scheduling-related analytics, commercial exploitation, or any purpose beyond the synchronization functionality.

AI/ML Model Training Disclosure: “BUSCO INMUEBLE” does not use Google user data, including Google Calendar information or basic profile data, to train artificial intelligence or machine learning models.

3. Data Sharing

“BUSCO INMUEBLE” does not sell, rent, license or transfer Google Calendar data to third parties.

Calendar event data is processed exclusively by our internal systems to provide the synchronization service.

Basic profile data (such as name and email address) may be shared only with real estate clients when strictly necessary to provide the services requested by the User (for example, coordinating a scheduled visit to a property), and always in accordance with our general Privacy Notice.

Calendar event details are not shared with advertisers, external platforms, analytics tools or surveillance organizations.

4. Data Storage and Protection

The OAuth access tokens and refresh tokens required for the Google Calendar integration are stored in our secure database under restricted internal access.

All communications between the Digital Platform and Google services are encrypted using industry-standard SSL/TLS protocols.

Data is stored following strict confidentiality, integrity and availability controls to prevent unauthorized access or misuse.

Calendar event data processed during synchronization is not permanently stored unless necessary for the proper functioning of the service, and in such cases is retained only transiently.

5. Data Retention

OAuth tokens and related synchronization data are retained only for the duration of your active integration.

If the integration is deactivated, the tokens are immediately discarded and access is revoked.

Temporary synchronization data is retained only to the extent technically necessary to ensure proper functioning.

6. Data Deletion and Access Revocation

Users may revoke access and request the deletion of Google user data at any time through any of the following mechanisms:

• Disconnect Google Calendar from the account settings within the Digital Platform.
• Delete your account on the Digital Platform, which triggers the immediate deletion of all stored tokens.
• Revoke access directly in the Google Account permissions: https://myaccount.google.com/permissions
• Send a deletion request to our support team at: contacto@buscoinmueble.com

After revocation or deletion of the account:

• All OAuth tokens are deleted immediately.
• The Platform ceases all processing of Google Calendar data.
• No Google user data is retained from that moment onward.

“BUSCO INMUEBLE” means Busco Inmueble INAMMOG, with address at Calle Tánger 71, Colonia Aquiles Serdán, Alcaldía Venustiano Carranza, C.P. 15430, Mexico City, Mexico.

The Digital Platform is www.buscoinmueble.com.

The Services are: The sale of a space for the publication of classified ads for the lease and/or sale of real estate on the site www.buscoinmueble.com.

These General Conditions are governed by the laws of the United Mexican States. The User submits to the jurisdiction of the competent courts located in Mexico City, expressly waiving any other forum and/or jurisdiction that may correspond to them by reason of their domicile.
